Planning a Wedding? Don’t Skip the Legal Side
While flowers, venues, and guest lists get a lot of attention, one thing couples often overlook is what happens after the vows. To make your union official in the eyes of the law, you’ll need to register your marriage — and apply for your marriage certificate. Don’t worry, it’s not as overwhelming as it sounds, and we’ll walk you through it.
What Does It Mean to Register a Marriage?
Registering a marriage means recording your union with the Department of Home Affairs. It’s a legal process that proves your marriage exists under South African law. Without registration, your relationship may not be recognized — and that can create problems later when applying for spousal visas, loans, or changing your surname.
When Does Marriage Registration Happen?
The process begins right after your ceremony. Once you’ve signed the marriage register with a legally recognized marriage officer, your details are submitted to Home Affairs. You’ll get a handwritten certificate (BI-27) on the spot, but that’s only temporary. The official marriage certificate needs to be applied for separately to be recorded in the national registry.
How to Apply for the Official Marriage Certificate
To receive your official Home Affairs-issued marriage certificate, you’ll need to:
- Visit your nearest Department of Home Affairs
- Complete Form BI-130
- Present your BI-27 temporary certificate
- Submit copies of both spouses’ IDs
- Pay the fee (about R75–R100)
If you were married outside South Africa, you’ll also need to submit proof that the ceremony met local legal requirements, and you may be asked to provide an unabridged version for international use.
What’s the Difference Between Abridged and Unabridged Certificates?
An abridged marriage certificate only includes basic info like your names and ID numbers. It’s fine for local use. An unabridged marriage certificate, on the other hand, includes full marriage details and is often required for immigration, overseas applications, or apostille services. Always request the unabridged version if you’re planning to use it internationally.
Can You Register a Marriage That Happened Long Ago?
Yes, but you’ll need extra documents. If your marriage wasn’t registered at the time or the records were lost, Home Affairs may ask for:
- A sworn affidavit
- Witness statements
- A certified copy of your original BI-27 (if available)
- Proof of identity for both spouses
