What Happens to Shared Property?

If you were married in community of property, you’re automatically entitled to half of the estate, as it was jointly owned. If you were married out of community, your rights depend on whether your husband had a valid will or not. Either way, the estate must go through a formal winding-up process, and your marriage certificate and death certificate will be required.

Are You Entitled to Your Husband’s Pension or Policies?

Most pensions and life insurance policies have designated beneficiaries. If you are listed, you’ll be contacted or can claim directly using the death certificate and your ID. If no beneficiary was named, you may still be entitled to a share through the estate. A lawyer or executor will guide you through that process.

What If There Was No Will?

If your husband didn’t leave a will, South African law (under the Intestate Succession Act) determines who inherits and how much. As the surviving spouse, you’re legally entitled to a significant portion — often the first R250,000 of the estate, plus a share with any children. Again, a death certificate is essential to begin this process.

Other Things You May Be Entitled To

Besides inheritance, you may also qualify for:

  • Spousal maintenance (under certain conditions)

  • UIF death benefits (if your spouse contributed to UIF)

  • Funeral policies or death cover

  • Access to joint bank accounts, pending estate procedures
